JHAINS Posted February 24, 2005 Report Share Posted February 24, 2005 I have a medical account for $500.00 that was originally turned over to NCO FIN/38 (Date Reported-07/02, Date Opened-05/02)It was sold to ATTN LLC (Date Reported-01/03, Date Opened-05/02)West Asset Management (WAM) then purchased the company ATTN LLC and is now listing WAM on the Credit report (CR) (Date Reported-01/03, Date Opened-05/02) I find it odd the ATTN LLC and WAM have the same reported on and opened on date. I need to pay this off (as requested by my mortgage lender) and was fully willing to do so if WAM would agree on paper to do what they have been telling me on the phone that they would do. They refused to sign anything so I sent them a $500.00 check with a settlement letter stating "I agree that I would pay the $500.00 if they would list the WAM as paid in full and delete/remove the ATTN LLC listing". I secured this by stating "by the cashing of this check #XXXX WAM agrees to the terms and conditions set forth in this letter....etc". They called last night and informed me that they are sending the check back because they do not agree with my terms, specifically the delete/remove ATTN LLC. I argued that WAM purchased ATTN LLC and it is the same account with the the same reporting period just now part of WAM. They verbally agreed but stated that I do not know how collections work and they cannot remove or delete anything. Is there some law that states that multiple listings for the same account cannot exist on your credit report. It looks like I have three $500.00 collections. Please help!!!!! retmar Posted February 24, 2005 Report Share Posted February 24, 2005 You can dispute it through the CRA's as "Not Mine". Wait the 30 days to get the results. The 1st CA should not respond as they no longer have the debt. The current, having purchased the other, should not respond to the prior, but, only to their own. Here is the good part, if they verified both, then they are in violation. A CA cannot report a debt as an active collection account if they are not handling the account. Therefore, the 1st and 2nd should not be verified. But, if the 1st or current does verify both, you have some good ammo to get them out of your life.
