Mannerheim
1. I have 106 inquiries between the 3 CRAs. 30 days ago, I disputed them as not mine, and I received a blow-off letter. Since then, I have placed fraud alerts with all 3 bureaus, filed a police report, and mailed a copy to each bureau, with a demand letter to remove the inquiries (as fraudulent) immediately. Still pending.2. I have 3 paid judgments. I disputed all three with the CRAs, stating that all three were to be deleted upon payment in full. The CRAs claim that they verified all, and sent me a lecture letter stating that these items would remain on my report for many more years. I then contacted all three OC's, and they have agreed to release the judgments. I have received copies of the Orders Dismissing the Judgments, and I plan to send them to the CRAs, with a letter requesting immediate removal.3. I have about 12 misc. collections paid/unpaid over my 3 reports. All CRAs claim that they came back verified (I don't believe it - Experian had listed 3 of them as open disputes until the last day of my dispute period). How should I best handle these paid (vs. unpaid) collection issues? Should I do a method of verification? I've been looking around on the site regarding this issus, and would appreciate some direction/link in this regard.4. Regarding late payments. I have a few accounts that have several (50% +/- due to former unemployment). In many cases, these entire trade lines were deleted. I contacted the CRAs, and they said that it wasn't them, it was the OC's that removed them. I assume that these lines will stay removed (if the account is old and not paid any more). If they are existing accounts, I assume that the whole line will pop back up when my next payment is reported. Is the best (only) way to delete these late payments via "good will" letters? Is there no good way to attact individual late payments via another method?5. I noticed that in a few cases, all three bureaus deleted my payment history, yet the CRAs listed the account, as well as comments like, 30 days late (without a visual payment history). Does this account information ever go away?THANKS a lot for your help! I hope to return the favor by helping others!Andrew
Mannerheim
One thing I forgot to add is, after filing about 30 disputes with Tranunion, after the 30 days were up, they sent me a one page reply summarizing the FCRA. I don't know if they investigated anything!
Sultan
ROFL Sorry man your a card; guy, I like your style your very persistent, but you gotta move slow on these things, never dispute everything at one time, this makes it look frivolous, systematically dispute a couple and wait. Then do it again. Then wait a few months and do it again, you can dispute something more then 1 time, as long as you allow enough time spacing. 106 inquiries? ROFL dude how could you pull that off, I’m seriously laughing my azz off. OK I know this is serious for you so now that I have it out of my system I’ll read your post again and see if I can offer any other input, I know that I have written demand letters for removal of inquiries to the original source and had them removed that way. I know that inquiries are a bit of a different animal as opposed to collection accounts which have more restrictive verifications requirements and do not fall under the guise of permissible purposes as some inquiries that you may not have authorized do.As far as judgments I can't even get the idiots in my own county of residence court house to understand the paperwork for propper removal of a judgment, thats where I believe it has to be done unless the abstract of judgment showing full satisfaction is all that is needed. I wish I could answer the question for both of us.As far as your TransUnion disputes they may have deemed them as frivolous therefore they did nothing, you could be correct, or you simply need to give it more time, or maybe call them and see if anything is currently in dispute. If you disputed 30 days ago and have sent in additional info like police reports, additional letter, etc... it will extend their investigation time each time by 15 days.So now, they have at least 45 days plus 5 days mailing time.2. Also see what the laws are in your state for licensing and bonding. Check it out with your state and make sure they are meeting the licensing and bonding requirments. You can use that as leverage. For more on DV go here: http://www.debt-consolidation-credit-repair-service.com/phpBB2/viewforum.php?f=13&sid=e267eee40fbbc54a6db95102dcac2aa24. Regarding late payments. If the Tl is still active, it should rereport when it is reported in the next month or so. The best method to use for late pays is good will letters. It will probably not happen with the first letter, but be persistant. Also try sending it to the higher ups and not CSR.5. Keep good documentation, it may not work on the first try... but that is the best way to start. While keeping good ducumentation is key to this process, how does that help him? or any of us understand how to handle judgments, I have a release of judgment and to be honest I have had such horrible luck i'm almost feeling like I will truly have to have it vacated before it gets deleted even with the release, am I wrong? don't guess about this stuff if you don't know its one of the hardest things with credit reporting not near as easy as a collection or an inquiry, a judgment is a court order, which any ripoff artist could get if you defaulted it by not showing up. Maybe even if you weren't properly served and didn't know about it. Question again, does a release of judgment mean that it must be deleted? workinninetofive
Hi Andrew,I haven't had luck with the comments.. your half way there though. During one round, dispute the comments. =) Hopefully you will get lucky. You could try saying something like: I previously disputed this with you. Your corrections are reflecting the correct payment history (I know it doesn't have one) but have yet to correct the comment "30 days late" under comments. Please delete this asap. Good luck
Mannerheim
THANK YOU EVERYONE FOR YOUR THOUGHTFUL AND HELPFUL RESPONSES!As for the judgments, I contacted my local court, and they asked me to file a MOTION TO SET ASIDE AND DISMISS ACTION. The first plaintiff was AIRTOUCH CELLULAR. I finally tracked them down (now Verizon), called their legal department, and the attorney that answered jumped through hoops to accommodate me. He faxed me a sign release, and I presented it to the judge for signature. The second plaintiff was Sears/Sherman Acquisition. I've had tremendous runaround with Sears/Sherman/Alegis. Everyone wants to help me get this judgment vacated, but no one will initiate it. It's a big circle of phone calls, but someone will eventually crack. The third judgment was local, and the law firm that filed it quickly signed off on the order to set aside and dismiss (vacate). There was no charge to file these motions.I expect to pick up two of the signed motions tomorrow, and then forward them on to the bureaus.----------Should I expect these items to be deleted upon receipt, or do I have to wait for the whole dispute process? Thanks again everyone! As always, MIRACLE, you are especially a big help. Thanks Jenn!Andrew
Sultan
kickazz dude rock on, i'm thinking about taking a day off and going to deal with the tards at my county court house and sitting there all day to get a motion filed if i need to, i handed them paperwork once already and they lost it, - NO JOKE. Im encouraged to hear your story though so i'm not giving up.G/L & peace
Mannerheim
Hi Sultan,Thanks for the encouragement. One thing I might suggest.... As I've been thinking about it this evening, I think I'm going to try another approach with my Sears/Sherman/Alegis runaround (everyone wants to help, but no one wants to initiate action). The court wanted someone to file a Motion to Set Aside and Dismiss, which usually comes from the plaintiff. In Verizon's case, they would not file the motion, but they sent me a letter saying that they would not object to me filing a Motion to Set Aside and Dismiss. Their big concern was that they didn't want to have to appear in court.I'm thinking that if I can get one of the Sears/Sherman/Parties to write me a letter that they won't object to ME filing a motion to Set Aside and Dismiss, perhaps I'd have a good chance of getting the item removed.IF I sit and do nothing, Sherman has agreed to RELEASE the judgment, but I'm not sure that is enough.Hope these thoughts might help you! Maybe just getting a letter stating that they won't object to your motion to set aside and dismiss (vacate), would be enought to get what you need taken care of.Good Luck!Andrew
Sultan
Thats a good point about getting a letter.I'm thinking that if they no show we get our judgment set aside by default just as a default entry of judgment would go.It's really good for us to pick each others brains.I'm working on the motion and declaration right now and I'm going to make sure it is properly accepted and filed tomorrow with the court clerks. I need to just go for it on this one its been bugging the crapola out of me for 2 months, and having perfectly clean reports is our ultimate goal, we should be willing to go to any lengths to get there, I know I am, once I get wound up its on and I'm seriously on a mission like you Andrew. Keep at it man. I'll post back on the results of getting it accepted. filed, and served.
Mannerheim
Hey Sultan, The one thing I should've mentioned, is that if you get that letter, you won't have to set it for hearing. If both parties consent in writing (plaintiff and defendant), your motion can be granted EX PARTE, which means that the motion, consents and order granting the motion are sent to the judge in his chambers for signature/appoval without hearing!Good Luck!Andrew
Sultan
Andrew,Dude I filed the paperwork, it was accepted properly filed and proof of service, via certified return receipt U.S. mail. This time they gave me a court date, I think its best I get the ball rolling on this one myself, now I may send the letter to them stating suggestively that they can possibly fax or send a letter back of agreement or no contendment. On this particular one they sent their proof of service to the wrong address, I pulled the file and the proper filings for the request for judgment are not even included, this Judgment is as defective as a 3 dollar bill, not only that its paid in full, they could have just asked me for the money with out getting all crazy and getting their BS judgment entry with out serving me properly or filing the paperwork correctly, I would have just paid them, I did any way. Funny thing, its the EDD (Employment Development Department) government agency, so the court clerks allowed incorrect, incomplete paperwork through or something thinking that it must be correct because it was the Government.... NOTDude, I'm really happy to be swapping info with other level headed people who are on the same or similar mission. The court date is set for April Fools day 05 I'll wear a suit and tie and have all of my ducks in a row or maybe a letter will be sent from them and the judge will just sign the order. I seriously need to get it removed I have a family to support and I can't be paying hopped up interest rates or losing opportunities because of.........well you know.Peace. & G/L
Mannerheim
Good luck with your case, too!Once you know that they've been served, are you going to contact them to quickly resolve the matter? It sounds like you're in the drivers seat, at this point. In regard to this case, given these new facts, can you file a motion to set aside and dismiss the judgment? I'd be glad to email you my forms. The court wanted the Plaintiff to file it, but they wouldn't. So, I filed the motion, and had them sign a stipluation that they didn't oppose my motion. If it would work for you, I be glad to post it.Again, good luck, and keep my posted!Andrew
