Seapup Posted February 27, 2005 Report Share Posted February 27, 2005 I was ONE month away from the SOL running out on a credit card debt (Providian), 3 years in my state. I checked my credit reports two days ago after getting a "fake" letter from a law firm trying to get me to make a $70 payment and saw, low and behold, the date of my last payment was moved from 2002 to 2003. I think the proof is up to me. How do I prove to the Big 3 I have not paid these guys is the last two years without sending them my bank files???? willingtocope Posted February 28, 2005 Report Share Posted February 28, 2005 The CRAs don't care about the SOL. The SOL only applies to law suits. If you're sued by the CA, then you can raise the "its beyond SOL defense". The CRAs will continue to report the debt for 7 years + 180 days...On the other hand, if you have a copy of a CR from several months ago showing the DOLA in 2002...and a new CR showing a different date...then you have a legitimate case against someone under the FCRA. I'd suggest you send a letter to the Providian saying that you can prove that the CA acting on their behalf re-aged the account and they need to immediately remove themselves and the CA from your CR's or you'll see them in court.
