willingtocope
Need more info, I'm afraid. I gather you sent Calvary a DV and have not yet received a response...how long ago did you send the letter? Is there a tradeline on your credit reports? If so, has it been marked "in dispute"?And...a DV to the original creditor usually doesn't work. They're not required to respond. You could call them (be prepared for a "why didn't you pay us, deadbeat" treatment) or send them a letter asking for details of the account, but you should only do that if you have a legitimate reason to beleive you don't owe them anything. Flipper762
about 30 days ago. Sprint PCS was the OC and the account is almost five years old. Those turds at Cavalry never bothered to send a letter stating that thery were trying to collect on this debt we just pulled our credit reports one day and bamm there it was. I recently sent them a ITS letter but I doubt that they will respond to that either.
willingtocope
You might look up the SOL for Louisana...it could be this is beyond the time limit. Doesn't mean you can get it off your CRs...just that if they sue, you've got an absolute defense.
shafted
I just sent cavalry my second DV this morning.. no response from the first one, about 37 days ago.. They just reported the debt to experian over the weekend (of course with out listing in dispute). Thats 2 more violations, which pushes them up to 6... maybe more if it is in fact a violation to report each one open since they are old and no open. Then it goes to 9. I mentioned in letter #2, they have already broken FDCPA, and FCRA (I didnt list any details), and that I could already file a successful suit in smalls claims court. I basically gave them 15 days to respond, or I would be forced to file suit to protect my credit interest.. I know they wont respond.. My only worry now is that if I sue them in court, they still dont have to remove the negs unless I sue in federal court.
Chancy949
I posted something similar about this on another thread.I got them to go away by providing all the evidence that I "acted in good faith", gave them 3 chances to Validate and they keep violating, then file an ethics complaint to ACA. http://www.acainternational.org/ their watchdog.Pretty soon its easy to get them on more violations than the debt is worth.OH and to all of you "moral police" out there *lurking*, if you'd just follow the law, we couldn't get you on violations. Now you can tell the CA to Pay Up Sucka!
gdouglaslee
You're going to sue Calvary Investments LLC in a smal claims court in MD? You might want to research that a little more so you don't have any suprises.

jojo67
Should I just try to send Sprint PCS a DV letter?I seemed to have decent resaults with filling a BBB complaint against SPCS. I've spoken with Billy Youngs, a nice gentleman that helped resolve this matter at Sprint's executive offices. It's resolved in full due to billing errors on my account. Now I wait for Calvary to update, they changed the amount owed once, to $94 instead of the $259, however last weekend they appeared on my EX report, for the full amount of $259, and updated with EQ for the same. GRRRR!!!!!!!! the funny thing is they changed the address they are collecting from, to PHeoneox AZ,the letter is from Tempe, but 2 of the listings are in NY ??? which address am I suposed to deal with? Seems they are sneaky and want to stay elusive and challenging to send corrispondance.

Begirl
I DV'd them...it took about 3 - 4 months, but they did finally send me a whole packet full of documents. Sometimes they take a while, but will come up with it...so just be prepared.

No such thing as un-breaking the law.$1000 is 5 times what they say I owe.. If CPS is smart, they wont risk a lawsuit over a $200 debt they paid $2 for. That would be insane. This is business, not personal.
