bluangel7 Posted March 3, 2005 Report Share Posted March 3, 2005 Is it normal for the amount of a judgment to be one thing in the first complaint then totally different in the ensuing court papers filed? I know there are attorney fees, court costs, interest, but every time I look at the balance before all these are added, it is a different amount.Could someone advise me about this? bluangel7 Posted March 4, 2005 Author Report Share Posted March 4, 2005 It is a default judgment that was obtained against myself and my ex-husband last year. It has just totally confused me. The amount on the original complaint was against him for 2346.50 plus interest, attorney fees, and against myself for 3562.01 plus interest, attorney fees. That was filed last April. In May, they got a default judgment against us. It says, we are jointly indebted to them 2257.08 plus interest, attorney fees, and he is indebted to them 433.87 plus interest and attorney fees, and I am indebted to them 1649.38 plus interest and attorney fees.Because we were both stupid, we didn't respond to this complaint, mainly because I have been making monthly payments to them since the beginning of last year and didn't really thing much about the complaint. I called the attorney's office and they said not to worry because I was making pmts.Well, fast forward to now, as of the week before Christmas last year, he got notice from his employer that his wages were being garnished with the order of his garnishment total 3120.20. Feb. 4 of this year, I got a motion for proceedings supplemental in my door that stated I had to be at court yesterday and my balance was 4786.75. Got to the courthouse, their attorney was there. I talked to him and he said my balance was 3900 and some change but I didn't write down the amount. He asked me if I could do anything about the balance yesterday and I told him I had been making pmts since early last year and he acted totally surprised and said, "I wonder why you are here then?" I asked him if he wanted to see all my cancelled checks that they had cashed and he said no. I had everything in my binder there with me. THEN, he tried to give me the collection agency's address to send my checks to because I have been sending them to his office and I told him no because they posted my april of last year's pmt to the wrong account. I just honestly do not know what to do. I got a printout from the collection agency of what accounts I still own on and I am not disputing that I actually owe them, because I know I do. I am just confused as to the different amounts they say I owe on everything. At the end of the printout, they had a balanced owed on all accts. of 4633.81. Sorry this is so long.
