rainy Posted March 4, 2005 Report Posted March 4, 2005 I've done a lot of reading, but still not sure on this. I have a CO from Capital One thats been assigned to CA, Arrow. CO is 3 yr old and only reporting by OC. I DV Arrow twice and they did not verify sent nothing. I'm not sure what to do next. I'm confused about this because it's still with the OC and thats kinda murky to me and it's Cap 1. Help please I need a stratagy.thanks
DocDon Posted March 4, 2005 Report Posted March 4, 2005 I don't think they assigned it. Arrow buys bad debts. I'll bet Arrow now owns the debt, paid pennies on the dollar for it, and now wants to make a hefty profit off you. Here's what you remind Arrow of (and what you have to do to get them to comply):Coppola v. Arrow Financial Services, 302CV577, 2002 WL 32173704(D.Conn., Oct. 29, 2002) – Information relating to the purchase of a bad debt is not proprietary or burdensome. Debtor must phrase their request clearly to obtain: The source of a debt and the amount a bad debt buyer paid for plaintiff’s debt, how amount sought was calculated, where in issue a list of reports to credit bureaus, and documents conferring authority on defendant to collect debt.
rainy Posted March 7, 2005 Author Report Posted March 7, 2005 Well it looks like Arrow is out of the picture and OSI is in. I got a call on Friday from someone with OSI about my Capital one account. What happened to Arrow? DocDon I called Capital, and they did not sell it, but assigned it now to OSI. So here we go again I guess I have to wait for them to send me something in writing and then DV them. Should I send a letter to Capital one and ask for copies of my signed agreement and old statements?
