sxxx
I thank you guys for your wonderful knowledge and hope that you can help me.Before I found this forum I paid Cavalry, and settled the account, the original creditor was sprint.I received their notice that they purchase the account in Jan 2005. But they reported the debt to the CRA's in Dec 2004. So I never had a chance to maybe pay it before it hit the credit report. So now as I look thru my older credit reports, Cavalry was looking at my credit in NOV 2004, and DEC 2004 without sending me any notice. Now I have a PAID COllECTION, and desperately want to get them deleted. What legal rights do I have under the FCRA, and what type of letter should I send them? I never DV'd them, or anything
Guest
You need to call them and ask when they BOUGHT the debt.If they pulled your credit BEFORE they bought the debt then you can go after them for non PP of your CR.Threaten to sue them..and be VERY serious about it.Send and Intent to Sue to their legal counsel in Hawthorne, NYI just did this with them and they folded like a wet noodle.Goodluck
sxxx
Thanks Sky WalkerI've looked on my credit report, and they pulled it under Account Review Inquiries, I guess that is a soft pull. Does that count?Do you have a copy of a good Intent To Sue Letter, because I don't want to even play with them, I am about to close on a house in June, I have no time to waste with them And they also did a hard inquiry in Jan 2005 after I had talked to them and made a payment, the first person I got was nasty, so he retaliated and pulled my credit, then the next person I got agreed it was retaliation, because their company policy is they don't pull anyone credit who amount is $500 and less. They stink
angthiel
This is uncanny. SRAV Cavalry has done the same thing to me and in the same time frame December 2004 over a sprint bill in the amount of $470.00. The problem is I have a closing date of March 25, 2005 on my home and these scandalous idiots dropped my score from 72 to 100 points when they reported in December. They undid every bit of work that it took me 9 months and over $900.00 in credit report/ score fees, certified letters. Without ever contacting me or replying to my certified letter.I have filed a complaint on this company with the FTC and the Attorney General's office. I personally don't care about suing them-- I want more, this company should not to be able to act in such a heinous manner and destroy individuals dreams and goals. It is apparent they feel they are above the law and do not need to treat consumer's fairly. If it is okay with you I am going to include your experience in my correspondence with the FTC. My case is not isolated and anyone who has been treated miserably by Cavalry Portfolio Services please contact me ang_thiel@hotmail.com I will include your letters with mine to the FTC or file a complaint directly. Champion80
So I am confused, who is reporting the debt, Calvary or Sprint?? Either way, now that you have paid the account, have you disputed the account as deletion with payment or any such action. Go through those steps, hopefully you will get deletion and will not have to work further, so you have a little confidence, I had a paid CO that was deleted on 2 reports with a dispute to the CRA's, but remained on EX, then I disputed 2 more times, and it was eventually deleted. You options are definately not up, just stay focused and patient, it will all work out in the end!!
