Can they do this?

I have a debt with OC for $98, and they have been calling my house twice a day. I haven't talked with them yet. (I just got my "inch high private eye" phone tapper yesterday, so now I'm ready!!)

They also have CA#1 (lawyer) attempting to collect on this debt. The last letter I received from him was dated 1/24/05 telling me to "Contact our office withiin 48 hours from receipt of this letter; otherwise, we will follow our client's instructions to collect this debt. Make your money order payable to OC."

And then I received a dunning letter from CA#2 (another law firm) dated 2/11/2005 for the same account, same amount, again with intructions to make payment out to OC.

I have CRs from 2/25 and only CA#1 is reporting. The OC is not. I checked today and now both CAs are reporting on this one account. I just sent out DVs to both of them this week. SOL isn't up yet. Can two CAs and the OC actively try to collect on one debt?

Should I talk with OC and try to pay for deletion (in writing of course?)

Only ONE CA can legally collect on the debt ! Double-dipping is NOT legal. If the OC will still talk to you, then you need to find out which one of these CA's has the LEGAL RIGHT to be collecting. If they won't talk to you, then you need to DV and stick to your guns as to proof legal right to collect on the debt. I would also mention to BOTH CA's, in writing, that the other is also trying to collect so you need the legal proof of who can collect.

Thanks Lady. I'll wait for OC to call and chat with them. According to my records, they usually call aroud noon and then again at 4pm daily. I was thinking that CA#1 must have given up trying, so CA#2 took over, but shouldn't CA#1 have removed his TL when he passed the buck?
