Information required from OC

Hey all,

I'm sorry if this has already been discussed but I can't find it in any of my searches. It seems so simple a question, so I'm sure it's been addressed, but I apologize in advance.

I know I can't DV an OC because the FDCPA doesn't apply to them. But what information can I request from them per the FCRA or FACT Act? How much time do they have to respond. If they don't respond, can I submit that fact along w/ my green cards to the CB as proof that the account cannot be verified? (The accounts have already been verified by the OC to the CBs, but I have no idea how that could be since I never opened the accounts!)

Any help is definately appreciated :-D

but how long does the OC have to respond?

You can dispute with the OC. What you do is dispute the debt and then request investigation from the CRA. When they verify incorrect information, they have just commited a 623(B) violation. If they verify without dispute notice, that's 2. If you live in Florida, that's 4 or 5, depending.

I have already disputed w/ the 3 CBs and they have come back verified. Do I need to do it again? If they don't provide me with the documentation I'm requesting (i.e. Statements, Sales Receipts, Original Contract) and I follow up with a letter stating they've violated FCRA Section 623(B), what Florida Statutes can I say they violated? Do I threaten to sue? Would I have a case at that point or do I contact the FTC and BBB and see where that takes me?
