So...here I am, gloating over the successes I've had so far, right, and I check my TransUnion report. Lo and behold, an entirely NEW negative has shown up. I have never seen nor heard of - let alone authorized - any account with 'Spirit of America National Bank.' (Is that a real bank?) This account appeared out of nowhere; did not exist on any reports since I first began monitoring in Nov/04.

This is listed as a $176.00 charge off (Profit & Loss Write Off) it was opened on 5/99, and is due for deletion on 12/05. I have just composed a lovely letter requesting, per Facta Act of 2004, complete copies of the original signed consumer agreement, address/contact info for the 'consumer' who initiated this account, and any payment history and associated records.

Has anyone used a similar request, have you had success/cooperation? If they fail to respond or comply, since the FACTA Act doesn't provide for consumer suit, do I then commence DV and subsequent procedures?

Never heard of them, but in looking around... they're a bank specializing in credit cards. They don't really do traditional banking, so to speak.
