Kylie Posted March 6, 2005 Report Posted March 6, 2005 I'm scheduled to appear for a hearing for MOTION FOR DISCOVERY....I requested validation from CA and CA has requested from court to be allowed to "institute a Request for Production of Documents without a deposition pursuant to Rule 1.351 fo the Florida Rules of Civil Procedure and serve same upon prior credit grantor to obtain all the documentation at its cost in order to satisfy the request of the Defendant."What am I expected to do at this hearing?
booger69 Posted March 6, 2005 Report Posted March 6, 2005 Bring whatever documents you have, they want to look at them. They will also need to bring their documents so you should be able to see what they have also. Are you the plaintiff or defendant? Keep asking questions so you can get at much info as possible.
Kylie Posted March 7, 2005 Author Report Posted March 7, 2005 Thanks for your response. The thing is, I'M not the one they're requesting Discovery from, they're requesting it from the OC.
booger69 Posted March 8, 2005 Report Posted March 8, 2005 Sounds like they need the documents from the OC to validate the debt. they know you will bring up the issue of validation & they will need to prove that the debt is yours. If your lovcal rules allow discovery then you need to get in on the paper chase to see if you can find something to help you. Is the SOL up on thie debt? If so you have an absolute defense, so use it!
