nolo Posted March 8, 2005 Report Share Posted March 8, 2005 I just got served with a complaint by a CA (in circuit court, not small claims) for some old medical debt, some of this debt is out of statute and some of it is within statute. The complaint includes hospital debt and a physicians group debt, as seperate claims for relief. The Complaint alleges a breach of contract in each claim but the plantiff did not provide a copy of the alleged contract(s). Could this be grounds for filing a motion to dismiss? I'm in Oregon. I'm new at dealing with being sued, I have read the Oregon rules of civil procedure (a bunch of times) and I've also searched the Oregon Revised Statutes but I'm still not sure about this.
