FishOn
I have 3 collections (2 open , 1 paid) from ID theft 6 years ago in PA. All 3 show up on TU, 2 on EX and until now just the paid acct on EQ. I DV'ed the CA and now one of the unpaid accts showed up on my EQ report Any idea how that happened? My plan now is once I get green cards back from DV letters to dispute with CRA's as resulting from ID theft once I file police report here in FL. Theoretically they shouldn't be able to validate as the acct's were for phone bills to the wrong address, but the CRA's should have to block regardless (once I supply required reports, documentation, etc.) since the acct's are the result of ID theft.Any thoughts? divemedic
This would be continued collection activity and is a violation, if they did receive the DV's before reporting. Wait for green cards. It happens, and is good for your legal case.
FishOn
The way I understand it is that if they report w/o validating it's a violation, BUT if I call them on it I can sue for a violation but they could still validate at a later date and then report to the CRA's? I understand it's unlikely, but is that the law?
workinninetofive
IF they validate later on and report to a CRA, the CRA will not notify you. Then all you have to do is make them delete it for failing to notify you within 5 days. Call them on the continued activity and they will hopefully just disappear for good.
