J Miller Posted March 9, 2005 Report Posted March 9, 2005 The wife and I are getting all our ducks in a row and hope to meet with an atty in the next week or two. With the Reform bill flying in the Senate and Congress saying they will not delay it, and the Pres saying he will sign it, how long before this thing becomes law?I'm looking for a time frame we have. I don't want the last 6 months of BK study to be for naught. How much time do we have? Thanks.J
willingtocope Posted March 9, 2005 Report Posted March 9, 2005 Your attorney will know for certain, but I have read that certain trustees are already basing some of their decesions on the new law...or at least delaying until they understand how it impacts certain cases.
bingo Posted March 9, 2005 Report Posted March 9, 2005 The new law will take affect 180 days after the legislation is signed into law.
nimbus Posted March 10, 2005 Report Posted March 10, 2005 I would find a lawyer who will be able to tell you about the any retroactive consequences of filing before the new law goes into effect. It seems resonable to think that as of the date you file the current law should apply but this may not be true. At any rate it is true that the law will take 6 months to go into effect. Lawmakers are still discussing one particular part of the legislation.
