A witress I knew was shocked to discover that her bank account had been attached, according to her it was attached specifically because of the tips she claimed. (She was an oddball tho - not sure I trust her account of anything) Sticky subject... hopefully an expert will know the answer. I would be interested to know as well.Which checks are you referring to... your paychecks or your IRS refund checks?? I think you mean your IRS refund checks. If you get a judgment against you the plaintiff can require you to appear in court to explain your assets and where your money comes from in front of a judge. Failure to appear at this hearing can lead to jail time. Lying about your assets can lead to jail time. If you don't get subpeonaed for one of these hearings, consider yourself lucky. Most states don't allow garnishments in excess of 25% of your wages...they'd get a whopping $5 if they never see that you make tips.And no, they can't show up at your work and take your tip jar.
