If the originalcreditor is a doctor, they aren't supposed to release any info to anyone are they? The original signed agreement for responsibility of bills is part of the medical record so how can a collection agency get access to this document? Even so, it seems like a request for DV would constitute a written authorization for release.Besides, there is no private right of action in HIPPA. Per HIPPA though, the CA should not have any actual medical records. i.e. treatment summaries and notes from your chart. That has happened. HeartRN Posted March 12, 2005 Report Share Posted March 12, 2005 In order to comply with HIPPA, the CA can request the info from the OC and ask that they send you the records directly...no middleman. Did you have insurance at the time and was any of this covered or supposed to have been covered? Do you have EOB's etc from the insurance company?
