Student Loans - Economic Hardship - Still Late!?!?!?!?

OK... DH and I consolidated our student loans two or three years ago... in September or so of 2003, we were 120+ days late... the consolidation loan was taken out with me as primary- my SSN is the account number... but DH is cosigner... so when I called to find out what we could do about not having the money to taked care of monthly payments, they told me that since I don't have any income (I'm a SAHM), I qualified for a retroactive Economic Hardship deferment. Once we got the paperwork through, they sent me a letter saying any negative info on credit reports would be cleared up- since the deferment was retro to March. (Naturally I don't have that letter any more...) So they cleared up my credit and I was happy.

March 2004 comes around and we have a bit more money... so we begin making payments again... but come June, we've got more problems. We were either 30 or 60 days late when I realized it... so I called (July or August) and they told me I had 2 more years available on the Economic Hardship... and they'd be happy to make it retroactive to June- thereby covering all missed payments. Yay! And again... when the paperwork was done, we got that same letter in the mail- that negatives on CRs would be cleared up. Again... they cleared up my credit reports.

So... Feb. of 2005... I pull mine and DH's CRs... DH's student loan TLs are atttrocious! They never updated his report. :shock: I dispute with the CRAs as never late- since that's what it should read- and that's what should technically be on file with the loan company... TU is the first to respond. They say they "updated" the information. Nothing has changed... except that it's "verified" as of 3/2005.

Where do I go from here? Are they (student loan) allowed to not update his? Or was this just an oversight? I'm assuming I should request a method of verification...

Bottom line- it can't have been "late" during months when it was on economic hardship deferment. Period. (Right?)

It just sounds like the SL company just forgot to include the corrections on your husb's accounts. Since you were the primary and you were the one making the contact, they just dropped the ball. I'm sure you can clear this up in one phone call to the SL company.

I would also ask for a letter from them confirming ALL the dates of forbearance for your files. Ya never know when they could lose some info and if this type thing happens again, you'll have proof at the ready.
