So here goes again :I want to try to get a old debt with Providian removed from my reports. The sol in my state has run out, and i did owe part of the amount...( interest, late fees, and etc... are theirs )The original amount was $ 900 ...doctors fees..hardships..If I were to write Providian, explain, and beg ... do you think I would have a shot of getting this removed ( or i will have 2 more years to wait)HAS ANYONE BEEN SUCCESSFUL WITH A PLEA FOR MERCY FROM A OC ??If so how did you word your letter???Thanks! willingtocope
Sorry it took so long for someone to answer. Lots of folks have found this board, and its getting hard to keep up.I guess I have three suggestions:a. What state do you live in? In Wisconsion, its illegal to attempt to collect on a Time Barred debt...and, I've seen some reference here that its against the FCRA to report time barred debts to CRs. (You'll need to do a search on that to see if you can find it...sorry). So...maybe, you write a letter to Providian saying you can't collect it so get off my credit report. Or....2. Do a search on "goodwill letter" and see if one of those fits your needs. If you have the money to settle, you may be able to plead for mercy and get them to fix things...but, remember, a paid collection is almost as bad for your scores as an unpaid one.One other thing to keep in mind is that if this debt is old enough to be beyond the SOL, chances are Providian has already done a "charge off" which means the US taxpayer has compensated them for their "loss". If that's the case, it may force them to do more work to refile their income tax than its worth. So they may not be willing to even consider a settlement. So...option 3...3. Maybe you should just dispute the item with the CRAs. If Providian has lost interest, maybe they'll just neglect to verify...
