twowheelrider
Two quick questions I sent my DV to CA and am ready to send the CRA my TL dispute. When disputing the CA's TL on the CR, do I tell the CRA's that I have sent a DV letter to the CA? Should I also request the CRA to delete it since it has not been validated? IamReady05
I wouldn't tell them I have disputed it until it comes back from the CRAs as verified. Then, the CRA's and the CA (I feel) would be in violation. How can the CRA verify it if the CA didn't verify it to you. I would just dispute with the CRA and wait to see what they say. <-------Just my opinion

twowheelrider
Here is where I am confused? This diagram found in the link below shows that you should DV the CA and also dispute the TL with the CRA's at the same time. I already sent my DV to the CA and now I am wondering if I should dispute the TL with the CRA's? I want to be able to have the evidence if the CA or CRA violate the FDCPA.http://www.creditinfocenter.com/rebuild/debt_validation_workflow.shtml

KentWA
I use a slightly modified version, just waiting until I know they have received my DV to dispute with the CRA. The reason? if they verify they have been in contact with the CRA and have your dispute in hand so if they did not mark it "in dispute" at the same time, they violated. Also in my case state law requires they forward the dispute to the CRAs immeadiately on receipt.

twowheelrider
Just to make sure I understand:1. I have already sent off my DV to the CA. 2. I wait until I receive my return receipt.3. I then dispute the TL with the CRA's by sending a letter CMRRR stating something like "A request was sent to this collection agency to validate this debt. The item is in dispute." 4. Check results from CRA to determine if CRA verified the account. If it was not verified. Request that it be removed. If it was verified, check to see if the item is tagged "In dispute".5. Check results from CA. If it was not validated be glad otherwise plan to settle.6. Follow the rest of the workflow. Does this appear correct? KentWA
Do Not tell the CRA that you have sent a DV to the CA. Some flunkey at the CRA may go ahead and mark the TL "in dispute". Just dispute it with the CRA as "Not Mine", "wrong dates", etc. That way you leave the CA to hang themselves when they do not report it in dispute.
