atak88 Posted March 16, 2005 Report Share Posted March 16, 2005 I have an account with sears that I stopped paying on around 4/98 I was expecting this account to fall off of my report this month however after speaking with a representative at experian I was advised that It wouldn't come off until 10/06 because it didn't go into collecions until 10/99. I really need some advice concerning this as this is the last negative item that I have and I would very much like it removed so that I can go on with my life. If you haven't tryed disputing with the bureaus yet you could do so. I think citi cards keeps stellar records though! I take it you paid a CA since you state there's no balance? kimj112 Posted March 16, 2005 Report Share Posted March 16, 2005 Hi, I am new here...I disagree with score booster - if you made your last payment on 4/98, according to the FCRA, the CRA can only report this information for up to seven years after the first delinquency (plus 180 days), if you never caught your account up-to-date. Please read the FTC staff opinion letter regarding this issue:http://www.ftc.gov/os/statutes/fcra/johnson.htmAccording to FCRA, this entry should be removed seven years + 180 days from 4/98, which would be approximately 10/05.I hope this helps.
