Now that the bankruptcy laws will be changing, will this still be a viable threat to use against a creditor?

Yes, but the conditions will be far, far different. They may or may not get SOME money from a Ch 13 (if you can't get a 7). They would still have to fie a claim for a Ch 13 in order to get ANY money thru the plan.
