OC application over the phone

I'm going to say yes on this. If a card or even just a phone order was placed, the OC could only send to an address given to them by a consumer. Let's say an item was ordered over the phone and shipped to your home. Many of these phone order places use UPS, which includes an automatic delivery confirmation to protect them. If Snail Mail is used, many will use the Confirmation for the same reason. Therefore, they can easily prove an item was received at your address. Though many will say that a signed contract must be presented, which I do agree with, it is still not a guarantee that you would prevail if you tried to use this as a defense. If this was a CC, then they could easily go to the place the card was used and ask for copies of the transaction and display the signature. Where I worked, we kept all CC transactions in the files for many years just in case it was necessary for any reason. True, there are probably some businesses who only keep their copies until tax time, then destroy. But, myself, I would be hesitant to use this as a sole defense as it could come back to bite you quite hard.

I know, and I wouldn't be even attempting it.. but the OC will not budge on the "paid for less than balance" entry. I have no problem paying it. I just can't get anything in return. It might be easier for me at this point to pay it and then dispute it. It might be a tad easier if they have already gotten $... just don't know with this one.
