Last year Afni, Inc. went on my credit report, I did what eveyone says and did not pay it, it was for $450 Cingular bill. It dropped my score then, but since then my score has gone up to around EQ 640. I am getting a new mortgage for my house so I had to pay off Afni, Inc. (I tried the "will you delete the file and I will pay" thing but had no luck), they are the only bad mark on my report. I paid them and the report showed the account as paid and my EQ score went up to 670. Well the other day Afni changed a few things on the file like 120+ days late and the account was still listed as open but a $0 balance. AND my score plummeted 50+ points!! WTF??!!

I called EQ and disputed the report should says under current Status "Pays as Agreed" and disputed the "open account" listing as well as Afni's failure to list it in the collections section, which the EQ rep said was Afni's right to do since they bought the account from Cingular. That part I cannot understand, they are a collection agency, and it should be a collection. This is the letter I sent Afni Inc:

Dear Afni, Inc.

I have paid the above mentioned account in full. Afni, Inc. is reporting this account incorrectly to Equifax, Experian and Trans Union. It is being falsely reported as an installment account and is also not listed in the proper category. It should be listed in the Collection Account category. It is Afni Inc.’s legal responsibility to report this information accurately to these Credit Reporting Bureau’s as outlined in the Fair Credit Reporting Act § 607. Compliance procedures [15 U.S.C. § 1681e].

In a good faith effort to have this dispute settled out of court I will give Afni, Inc. thirty days from the receipt of this letter to permanently remove this account from all three Credit Bureaus: Equifax, Experian and Trans Union. If my demands are not met within this time frame then I will be forced to file a lawsuit against Afni, Inc. for noncompliance of the FCRA. I will seek the full civil liability amounts and any such additional damages the court may allow as outlined in the FCRA § 617. Civil liability for negligent noncompliance [15 U.S.C. § 1681o]. I will also file complaints with the Federal Trade Commission, Better Business Bureau, ACA International and the New York State Attorney General.

Please forward this letter to your legal department.

Sincerely,

Me

Afni list the account in the "Account Status" as a "collection account", so shoudn't it be in the collections catagory?
