ccbongo Posted March 17, 2005 Report Posted March 17, 2005 Old credit card debt 5/1999, Judgement was awarded, at the time that was going on my mother was ill in the hospital. I wish I wouldn't ignored the summons to comply, but I had no choice. I just recently found out that the sol expired in 2002, I could of raised the defense about the sol. What makes me really mad, they put judges on these cases that do not specialize in that. If the judge was specialized in that particular law, the judge should of denied the request. I am trying to find out info to see if there is anything I can do at this point. Any help would greatly be appreciated.
Corrine Posted March 17, 2005 Report Posted March 17, 2005 I'm no expert but based on what I've read here I think you can have the judgement vacated (I'll leave that for someone else to explain) and then *if* the creditor tries to sue again you should definately appear and use the SOL as a defense.
divemedic Posted March 17, 2005 Report Posted March 17, 2005 It is not the judge's job to defend your case. You must show up or the plaintiff gets an automatic win.
