The FDCPA says you may bring your case to "any court of competent jurisdiction."Also contact the IL Department of Professional Regulation. www.ildpr.com. Illinois requires that all collection agencies in it's borders be licensed and bonded (at least until 2006). The State can fine collectors that violate the FDCPA. They are on my GF's report and are not registered in FL and do not have a registered agent in the state. Once they sign for it, they have been served, correct?If you get a judgement against them, make sure you contact Dun and Bradstreet the corporate credit bureau and make a notation, that hurts their corporate credit a great deal. Also, collecting on it depends on how much of an a$$ you want to be. Depending on how the CA treated me, I would do anything form attaching their bank accounts to contacting the local sherrif and arranging a date to start confiscating office equiptment and selling it off. THAT should get their attention. An asset search should be able to determine what they have. They usually run a few hundred bucks (1-300) Make sure to contact the secretary of state and find out their EIN or TIN, which is the same as a business social security number. Once you have that number, you can then start tracking down bank accounts and such. Do a search for the corporation or the officers and that should generate the necessary info, or include it in your discovery request at trial.
