Collection Agency

I'm new here. I recently started trying to clean up my credit and having problems with these collection agencies. I had one were I let them withdraw from my account in the amount of $100.00 and they took $105.00 . I went to my bank and did a stop payment and on the same day I called them and told them that they are not allowed to withdraw from my account anymore. After I told the representative. She said ok and I paid with a money order. Meanwhile they were still trying to withdraw from my account. February they were able to bypass the stop payment (thanks to my bank) and withdrew money from my account. How do I handle them. I want to dispute this new bill.

Welcome...hope we can help...

First, I'd suggest you close that checking account and go open another at a different bank. You could instruct your bank to not allow auto withdrawals, but since utilities, and other folks like to get paid that way these days, you're better off to just move your money. Once you give an OC or CA access to your account info, they'll keep milking it anyway they can.

Next, have you done the DV process on these guys yet? Never talk with a CA on the phone...always do it in writing, so you'll have proof should you ever need it. Start with a "prove to me that you've got the right person, the right account, the right amount, and the right to collect" DV letter.

You also go to the bank and DEMAND they take back the money they let the CA have. THIS CAN BE DONE!!!! I did the very same thing with Sprint.. they withdrew the money that Sprint illegally withdrew.

You have to go to the bank manager and raise a stink.. be professional but very firm and tell them that you would have no problem calling the Federal Banking authorities about this.

Then you sue the CRAP out of the CA for taking money out of your account without your authorization and for trying it on severak occasions.

I would get this info from the bank and ask them for a printout of all the times the CA did or tried to take money from the account.
