Question about Sherman

I'm getting ready to send out my DV to Sherman, but I don't know which address to use. I'd rather not send it to a PO box if I don't have to. Has anyone had any success with a particular address for them? Here are some that I've found:

Thanks. I didn't look too closely at my CR the other day. It lists the PO box in SC. I feel like an idiot now. :oops:

They're also listing the OC as OSI/Gulf State, which is not correct. Should I include something about that in my DV? The original debt is a Discover card that's over 5 years old and past the SOL. Sherman has never contacted me about this (nor have any of their sister companies), so my DV pretty much says I found it on my CR and don't know what it is...blah blah blah. Should I take a different approach to this, or just see what comes back after my DV?

you know, i have sherman on my cr and they have the same thing listed osi/gulf chase state credit or something along those lines. im not even sure who the oc is. i need to send them a dv letter also, just havent had the time to do it yet. please keep me updated with your response from them once u send the dv.

I had Sherman on my CR with the OC as OSI/gulfstate. OSI/Gulfstate is another collection agency; however I do believe they are out of business.

I sent Sherman a DV letter and they responded to me by sending me an 'affidavit of debt' after the letter. Don't let that 'affidavit' fool you, it means nothing. What I had success with in dealing with Sherman was..... (1) send DV letter (get one off the forum here)

(2) then go online or however you can dispute the TL with the 3CRA's

(3) wait for the responses

--while awaiting the responses and their probable FDCPA violations--

(a) brush up on the FDCPA and FCRA in particular about debt validation

(B) find out what the SOL are in your state

After I recieved Shermans 'affidavit' I was semi-versed in the FCRA and FDCPA so I waited. They will mess up by sending you this 'affidavit' more than likely. If not, they will violate something somewhere and there is your ammunition to send them a letter demanding they remove the TL or you will sue etc. I have spoken with several people who has dealt with Sherman and they all have had problems with them. My super-best advice....... Persistance beats resistance!

They did finally remove their TL after about 2 months of calls, letters, etc. This site really works..... it just takes time.

Believe me, I am very well versed with the FDCPA and FCRA as well as my state statutes on the SOL. I had a CA sue me last year for a debt that was past SOL, so I had to do a lot of research. I sent the attorney a nice letter when I received my summons, and they never showed up for the hearing. I was planning on cleaning up the rest of my credit after that, but I had some medical problems and had to wait. Now, I'm ready to jump back into it.

garynash, if osi is out of business, how would one go about removing them from their crs? i was lucky enough to have sherman remove from 2 crs and i'm just waiting for the 3rd one to fall off, but i see that osi is still listed in the collections section of my 3 crs and i want them off.

Hello. I just joined the board but have been reading some of the posts for a few weeks. Great Site!

I received a letter from Allied Interstate regarding a charged off balance with Sears. They are associated with LVNV. I sent a debt validation letter and received a response from Resurgent Capital Services. Enclosed was their validation, an affidavit from "someone". Obviously this is not good enough.

I plan to respond stating that the info they sent me does not validate the debt and to remove me from their collection list and....

Here are my questions. Was their reply a violation? I will send the reply back to Resurgent but should I also copy LVNV or Sherman so that they cannot pass this claim among them selves? I want to stop them here and not redue do this every time they send the claim to one of their affiliates.

LVNV IS Resurgent, they hired Allied.

You need to do more than just say they didn't validate, you need to SPECIFICALLY REJECT that affidavit. If you do not, you are tacitally AGREEING with what that stupid affidavit says !! This is a typical Sherman tactic to get around validation and the SOL. If you don't specifically dispute the affidavit, it creates an 'account stated' - you definitely don't want that !

LadyNRed, I'm waiting for Sherman/M.R.S. Associates/LVNV funding/whoever they are to reply to my DV. If I get the affidavit, would it be enough to write, "I reject in full the Affidavit of Debt", or is there something else more specific that needs to be written to make sure they know I reject the affidavit and they won't be using that on me?

Then in a separate letter I will write that what they provided was not debt validation and that I am again requesting strict validation of this debt.
