To file or not to file (simple chapter 7)

I am trying to determine whether or not to file a Ch 7 bk or not. As it stands, I have about $12,000 in debt currently listed on CR. I have another $7,000 worth of unpaid medical that will eventually be reported. The earliest date that one of the bad accounts will drop off is the end of this year with another one end of next year and the rest around 2008. As far as I am concerned, my credit is ruined. I certainly can't get any credit at this point. I am just trying to figure out if it is in my best interest to file. I should mention that I have no assets, no house, no car. I am married and my husband has no assets but he will not be filing. Which leads me to my next question... How does filing bankruptcy change when you are married?

If I file, I am going to file pro se...

Whatever you do, do NOT think about this for too long. The new BK law is probably going to be rammed thru the House next month and after Bush signs it, it becomes law in 180 days. Once that happens, it will be MUCH harder and more expensive to even get a Ch 7.

If you are married, your husband's income will probably have to be included on your schedules, it goes to household income and your ability to pay - or not. If the Trustee thinks you could pay your bills if your DH paid for all your living expenses you could get shoved into a Ch 13.

You really should try consulting with 2 or 3 BK lawyers, then decide pro se or not.

I am aware of the new BK laws but wasn't aware of the situation with my marriage. My husband and I are currently working with firstsource from the mortage boards to get a home though I will not go on the mortage because of my horrendous credit. Another issue I have is about my job. No taxes are being taken out at this time, I am a 1099. I have not paid any taxes this year. Should I even report I am employed?

Going to definetely talk to a couple of lawyers.
