J Miller
Greetings,My question is rather simple. We filed BK recently and wondered how Student Loans are handled after discharge? (SL's will not be part of the discharge). Will we be working with the Dept of Ed, or will we be dealing with the CA's that they are assigned too? I'm under the impression that once the CA's are notified of the BK that has been filed, they return the loans back to the DOE.I personally hope to deal directly with the DOE and not a CA. Any suggestions?-J
LynnInMN
While you are in BK and for awhile afterwards, your account will be in a suspended status. You will receive no communication and no one will contact you. Payments are handled via a lockbox. Even collectors at the DOE will not be permitted to discuss the loan with you for awhile, due to the suspended status. However, at some point in time, it will more than likely end back up at a CA, probably a year or so from now.
