I got a collection letter from them a few days ago for a large MBNA debt.

The letter offered a settlement, but I just can't pay.

I just sent them a DV letter a few days ago by fedex, so we'll see what happens.

I'll post my results.

That was a smart move. It will buy you some time. Not to scare you but they will eventually file suit and garnish your wages. I just settled with them with my wifes account. They did win a garnishment. Cost me $6200.00. They do not deal, and they make me sick. Keep us posted as to what happens. Good luck to you! I hope you beat them!

Sorry to hear that it went to garnishment. I'm in Texas, and we don't have a wage garnishment law as far as I'm aware.

So, I am waiting for them to validate the debt or file suit.

File bankruptcy on the SOB's! Be aware that W&A can usually validate because when their affiliates acquire debts they usually can produce the entire account transcript and not just the final statement. They represent snakes like UNIFUND comprised of a group of investors in an LLC who exist for the purpose of acquiring charged off portfolios for pennies then claiming successor in interest and suing the crap out of the defaulter. Unfortunately with pending bankruptcy reform their business model will become even more profitable as more people will be stuck and more likely to lose their homes, etc. MBNA stands to benefit as well with all of the binding arbitration accounts and high credit quality. They have brought a lot of money to the area and Delaware loves this outfit, but there are many hard working and struggling locals who would love nothing more than to see MBNA burn to the ground! So, if you are a bk candidate in either chapter wait until after W&A trudges through the system getting their judgment, then respond to them with your bk case number when come after your stuff!
