It is and old utility bill (telephone) that is my debt, but come on 12 years??? I am still resposible for this? by the way i was only 17-18 when the bill was made. i had a lawyer, family law but a friend of mine tell me that why bother paying a debt that isnt even on credit report. LadynRed Posted April 9, 2005 Report Share Posted April 9, 2005 Well, they CAN take legal action, it would be stupid, but not illegal. No matter what state you're in, the Statute of Limitations on this debt has long ago expired. That means that even if they DO go so far as to sue, you have an affirmative defense in the expired SOL to have the case thrown out of court. You are NOT liable for this debt any longer. Send the collection agency a cease and desist letter telling them never to contact you about the alleged debt again as it is time-barred. Send it certified, RRR and keep copies of everything.
