Judements reporting unpaid

My husband & I have applied for a mortgage. We have 3 medical judegements on our report from 2000. We just found out only 1 of the judgements are reporting as satisfied. The other 2 are showing unpaid. My wages had begun to be garnished on July 5 2000 for one of the "unpaid" garnishments. That order was fully executed on Oct 6, 2000. I contacted the courts regarding this specific judgement and the courts are showing there has been no payment received on this order. So I contacted my previous employer where the garnishments were executed and they verified that all monies were sent and this garnishment was satisfied. Later that day human resources from my employer phoned and said he found something interesting and that the payroll company that cut the garnishment checks did NOT send the money to the courts where it was orginally directed but rather sent the money to the attorneys for the hospital. Then the final check they were directed to make it out to the attorney himself. WTH?????? Upon further investigating this past week we discovered that my husband's wages that were garnished in 2001 are showing the same exact docket numbers as the original garnishment I had in 2000 (not for the second judement order). So they garnished on the same judgement twice and yet the courts still do not have anything showing these judgements have been paid. On the 3rd judegement it appears payroll again has screwed up and paid the CA not the courts. There is a tradeline on our report from the CA that shows they have been paid in full once again there are no records with the courts that this judgement has been paid either.

Our lender will not move forward until these judgments have been paid either by providing them proof or consenting for the lender to pay them off. I'm wondering what are our options at this point in the game?

Hopefully, you have already obtained the proof from your employer and your husband's employers regarding the proof of payment. Getting the actual release of judgment does not sound feasible in a short paeriod of time and you definitely have some issues to follow up on, to get your money back. I suggest the "Is there a lawyer in the house?" section for those matters.

As far as a mortgage qualification, you should still be able to get approved, if that is all that is holding you back. There are several good lenders that will ignore those judgments, and if your credit scores are good, will not have too much an affect on interest rate. When using one of these lenders, credit score and loan to value will determine interest rate. There are good alternatives out there for you.
