Met with another attorney and yet a

hello all,

im in the process of considering bk. my situation is that i would like to keep some of my household items as well as 2 cars. Mainly would like to keep furniture that was purchased from furniture store, some electronics, and 1 car that is paid for. Other car is still secured by a loan. Please keep in mind, I'm just wondering which way would be best for me without loosing everything i have. None of my accounts are late, I just know that the end is coming with robbing peter to pay paul minimums with my CC's & unsecured loans.

I have gone to see 3 different attorneys and each one had a different scenerio. The first suggested ch13 since i would like to keep items, the second said i could do a ch7 & just re-affirm some of the items like the furniture and said to sell the car and pay it towards student loan. The third atty said I don't even qualify for a ch13 and told me to sell the car and open an IRA with the funds. I have an appt with one more final atty next week but something tells me I'll get completely different advice from him too.

Before any of us can say much, we have to know what state you're in. Exemptions vary widely by state.

The last attorney is full of it. If you have a pulse and a regular paycheck you can file CH 13 ! Selling ANY property before you file would be looked at as a fraudulent transfer and would put you in hot water with a Trustee. BAD advice.

Thanks Ladynred for the response, we are in nc. After talking it over with my SO and realizing this is just no longer worth the hassle and stress that its been causing we are going to ahead and just file BK7 as one atty already suggested and let it all go.
