Question before I DV ........

Recommended Posts

Im sending out my DV and have a couple of questions I need help with first .

The CA was listed on my CR as open with a balance owed of around $700.00 , and it was listed twice.

I disputed . It came back and one was taken off and the other changed to closed , paid. 0 bal. due.

My question is ....on the begining of the DV it says something to the effect of " This is not a refusal to pay this debt " well since it now says 0 bal. due and looks like I have nothing to pay them .... should I include that part still in the DV letter ? because it now is paid ( atleast its listed that way ) or is there another way to word it , since they changed it to 0 .

Should I just sayin my DV . This letter is in response to information you have listed on my credit report . This notice is being sent to you pursuant of the FDPA etc. and leave out this is not a refusal to pay....or should I just leave that in there ?

Thanks...

OK , I have been reading as much as I can about DV'ing . I have seen contridicting post about DV'ing a paid Coll. Account.

Since it was listed as unpaid and I disputed with CRA without a DV ( It was a duplicate , I just wanted one removed , which they did ) They updated the TL to say paid 0 bal. and Im guessing I must have paid it off years ago , and just don't recall it ( im looking into my checks from that year )

So some say I shouldn't bother to DV a paid account thats about 4 years old , some say I should. I'm not sure what to do.

Should I just dispute something on the TL and see if it comes off or should I DV them ? They did update the TL when I disputed , so im not sure if they would just let it drop or not ?

Anyone that has done it on an account like this and had success ?

Vrandon----

So I wouldn't be asking for validation in this case ( because of the 0 Bal. ? is that why ? ) It would be more a dispute letter with them.

What do I say I am disputing ? Do I pick something like the date or something in the TL ? Or do I use the DV letter and just tweak it to say dispute , and not mention valadation. Sorry if im not "getting it " . This is the only CA I have on my CR that I have to actually deal with , so I don't wanna mess it up.

I substituted "dispute" because this was an old paid collection; your situation is a little different, but I still believe that the classic DV procedure you're following or the steps I used will work in your case.

Keep old copies of your CR that show an outstanding balance on this account. You sent a DV letter based on what you saw on your report; therefore, just because they change it to a zero balance does NOT mean they are free to ignore your DV letter. This should keep you covered in case this goes to court.

Have you disputed the account with the CRA's after the CA received your DV letter? That's a very important step. If the CA verifies the accuracy of the account with the CRAs and does not do the same with you, then they have broken the law.

You're on the right track. Just keep on keepin' on. :D

I have not sent any DV letters yet . This would be my first one.

I just disputed the collection account(s) [ it was listed twice w/ different bal. ] with the CRA ( EQ) as * not mine * . It came back and one was deleted and the one left was changed to say paid 0 bal.

So this will actually be my first DV with the CA. I only disputed with the CRA before this.

So I should just DV the CA now and dispute again with the CRA when I get my green card , right

sorry I can't seem to figure out the quote buttons
