Help IRS Notice!

I had my BK discharged in 1999. My BK included 2 debts that were private loans taken out for education. We received no contest to any of these and these were discharged.

I just received a notice from the IRS with changes made to my 2003 tax return that we now owe additional $4500 in back taxes due to a 1099 submitted by a company for the forgiveness of the debt.

The problem is my BK papers do not include this particular creditor name. They do include a creditor that has similar address and in the same zip code.

doesnt filing BK erase the debt so the creditor cannot do this?

Debts discharged in BK are NOT included as income as 'cancelled debts'.

If you can show you were insolvent at the time these debts were 'forgiven', then you'd better get form 982 and start filling it out. If the debts WERE discharged, then the 1099 is WRONG.
