krisb74
We sent out a DV to Atlantic Credit & Finance who claimed they were collecting on a Citi acct of my husband. They are not on any of his CR, just Citi as being c/o. Ok, it has been the 30 days and no response, do I send a second DV even though they are not listed anywhere? If I should, what exactly do I say? I'm a little confused b/c I can't demand for them to remove the listing, as there is none! Thanks!Kris
willingtocope
Basically, all you can do is wait for the next shoe to drop...there really isn't anything in the laws about a CA who's not reporting only having 30 days to respond. And for that matter, if they were on your credit reports, they could simply mark it "in dispute" and take their sweet time getting back to you. But, if the CA didn't respond, then either they can't validate the debt OR they're one of those collection agencies that only want the easy pickings...since you stood up to them, they'll move on.Either way, chances are the debt has been returned to Citi or sold to another Junk Debt Buyer. You might be hearing about this again.
tst888
I DV'd a CA that was not listing on any reports and also received no response. I went ahead and sent them the follow up letter but changed it a bit. I told them that since that hadn't validated the debt that if in the future it appeared on any of my reports they would immediately be in violation of the FDCPA and subject to fines of $1000 which I will not hesitate to collect on.as was mentioned in the above post, they still cant validate and report but I felt better sending them a little threat anyways and telling them they can't report it.
