Sent to collections without any prior warning?

My wife just received a letter from a collections agency regarding a credit card she has. We were surprised because we have been mailing payments to it every month and have not ever gotten a warning or any attempt to close the account from the credit card agency. We have no 30-day late payments or anything like that in the credit history. I understand my wife has sometimes mailed payments in a few days late, which is the only bad thing she's done. The balance is not over the limit either. This is the first sort of any "warning" or complaint about her account.

Are their laws or rules that say what they must do before sending us to collections?

I'm not sure how to approach this and I'm having trouble sifting through the mountains of information out there regarding credit laws. Can anyone advise me on this? I am in California if that matters.

Welcome...

First, in credit card land, "a few days late" is 30 days. But, that's not a good reason to dump it out for collections. I've got two suggestions...

1. Call the credit card company and ask what happened. Its possible this was done by mistake, or something else happend (like identity theft) that you don't know about. For example, if AMEX has you down for several accounts, and one goes seriously late, they'll close all and send them out for collections. Maybe someone else has opened accounts in your wife's name...which leads me to

2. Go to www.freecreditreports.com and get copies of both yours and your wife's credit reports from the 3 major reporting agencies. It will take some study, but you need to look for things that puzzle you.

Good luck!

Also, some cc companies have an internal collections department that sound like they are a CA. They usually call if you are approaching that 30 day limit and haven't paid yet and then will continue to call until you pay or it is CO.

Kay's is like that....."would you like to pay now to get this out of collections?" regardless, they mark it current on the CRA!
