CA's still report debt as valid with no validation

Recommended Posts

I have sent two letters to Calvary Portfolio Service and two other agencies to verify debts but still have not received anything yet to show proof of debt but yet the 3 CRA's reported the debts as valid debts. I contacted the FTC to file a complaint and still waiting for a response.

My question to ANYONE; What am I doing wrong? My debts should be validated and they are not, what tangible evidence is there to say that the debt is mine. Calvary was reporting this debt before I even got a chance to dispute it. So can someone PLEAAAASE help me I'm dying out here :(

OK - When Did you send these letters? Remember they have 30 days to investigate. They should list the accounts as in dispute as soon as they receive your request to verify.

Did you send the requests CMRRR ? and Have you received the Green Cards back?

let us know... and there'll be more help to follow...

If you have sent DV letters to the CA's, and if you have disputed the CA tradelines on your reports and the CRA's have verified, then send a letter to the CAs stating they violated USC 15 § 1692g(B). Demand $1,000 and full deletion.

If they ignore that letter, file your lawsuit.

Actually, CAs don't have to validate within any given time period. They just must mark any negative TL as "in dispute" and cease collection activities until they do validate.

Yes I'm on my second round of Certified letters. Today I have received the credit reports and guess what they are still there and they say "Consumer disputes account". I think this is crap, they won't send me anything but the CRA's say it is a valid debt. I'm at the point of highest fustration right now. Can somebody please help me? I am about to start my third round of DV's and getting kind of fustrated. :(

Yes, it is frustrating. Try not to get discouraged, though. Credit repair isn't quick or easy. I wouldn't keep DV'ing the CA if you've already sent two letters and they're only responding with their garbage. The CRAs probably aren't doing anything wrong since when they contact the CA the CA verifies the debt with them. You might want to send a Method of Verification letter to the CRAs. Search this site under "Method of Verification" and you will find a number of threads on the subject. I believe a sample Method of Verification letter is also provided under the "Sample Letters" link at the top of the page. Now might be a good time to think about an Intent to Sue (ITS) letter to the CA. Sample letters are also provided above. However, don't send an ITS unless you really do intend to sue.

Today I call CPS compliance office (after being on hold forever) they told me that a response will be mailed out soon. Now what do I do just sit back and wait or do I attack? I think that my complaint I filed with the FTC went through and they investigated. After reveiwing my CR last night it showed the account was sent to the CRA's in December but I was not contacted until this past March. Isn't that illegal?

Rule #1 of dealing with CAs...DO NOT CALL THEM! Correspond only in writing. Yes, if the CAs placed their TLs on your report in 12/04 then they should have sent you notice within five days of that reporting with the mini-miranda. If they didn't, then that's their first violation. Have you yet disputed the TLs with the CRAs? If so, and the CA is verifying the TLs with the CRAs without validating with you, then that's another violation. Once again, since you've already sent them two letters you needn't contact them again. If your goal is to get the TLs deleted, then you probably are going to have to send an intent to sue (ITS) letter, but only if you really do intend to sue if they don't delete the TLs. An ITS may be enough to get them to delete the TLs, or it may incite them to file suit for the debt.
