Blind man fraud

Recommended Posts

I will try to keep this as short as possible. I am writing on behalf on my brother. He is a legally blind man and resides in the state of Mississippi. After knowing a girl for two years she moved in with him. Without his knowledge, over a period of 5 months this girl maxed out what credit cards he had, She also opened credit cards in his name (approx. 5) and maxed those out. She opened them all online and most of the charges were online. For obvious reasons, he never saw any statements that came in the mail. She would make the minimum payments to keep the creditors from calling. She even forged several checks. Over this period of 5 months she managed to pay off all of her personal debt and even got her house out of foreclosure. During this time, he had no knowledge any of this was going on. Everything seemed to be fine in the relationship. After she was finished paying off her debt, she started pushing to get married. Well, they did get married then she took off. I know see why. No one will help him with this matter. The police won't do anything because they are married. They say it is civil. None of the credit card companies will do anything because they are married. They say he is responsible. The debt is approximately around $30,000. This girl had even used his deceased wife's name and social to get a credit card and used it as well. I am desperately trying to help him out of this and would like to see this girl locked up. Is there anyone that has any andvice for us?

MAny police departments still do not understand that ID theft IS a crime. As long as there is a police report on file you will be way ahead, the provisions of the FCRA only require a filed police report, not that they take action.

I'm sorry, but that's BULLSH*T ! Just because you're married doesn't mean they can't DO anything. SHE COMMITTED FRAUD, married or not, its a crime! Marriage doesn't bestow some magical protection on her, nor does it throw the burden on HIM when she committed a crime !

He needs a lawyer, the police are being morons in their draconian attitude about married people.

If they want to play hardball, get an organization like the ACB involved. This was a crime and it was committed because of your brother's impairment.

Sometimes the police need a little help with the law - they get too used to breaking up teen parties and kids on mopeds.

What a B**** Married or not , its a crime !! and she committed the crime before they were even married ! I can't believe the attitude of the police ( well actually , I can ) but its not his mess and he shouldn't be stuck with it . She had racked up a crap load of illegal activities and should be jailed for it , not to mention thats just an awful thing to do to someone !

Um, isn't the theft of $30,000 under such circumstances usually considered to be Grand Larceny - a felony with jail time, restitution and fines? I think it is time to stop talking to the police and start talking to the District Attorney, County Proescutor, State Police, the office of the Attorney General in your state, the media,a nd any organization associtated with the disabled!

One other thing, Mississippi is not a community property state. What this means is that all debt obtained in the marriage is NOT automatically the responsibility of both parties.

I'd get your brother to file a civil suit, and notify your state attorney general. You and your brother can't send her to jail, but you can possibly get the authorities involved, so they can pursue the legal matters. Unfortunately, you might have to get copies of the Mississippi civil code and even Federal law and waive it under their nose for them to get off their asses. Have you tried the AG's (attorney general's) office?

If he files a civil suit for damages, that will definitely get the attention of the state. Maybe leak the story to the news media? They love dirt like this.

We have tried going to the attorney general, and the DA, they wouldn't even let us in the door. I intend to contact the local television stations, might even drop Oprah a note. I was able to get the Secret Service to agree to take a look at it, but they didn't seem too eager. They did say that they would definetaly go after her for using his deceased wife's identity. I am also looking into some disability protection agencies. I'm going to make sure something gets done! Thanks for everyone's advice.
