LikeItOrNot
Hi. I've searched on this and can't find much info about how to go about disputing this. Back in July 2001, my Capital One account got closed and I had a balance on it. A collection agency called me to settle and I settled it for less than the full balance. Recently, I got all 3 of my reports and 2 of them are showing it wrong.Pics are easier to explain this so..Transunion:On another page they have (14) 180days late. I did the math. Every 4 months another gets tacked on. EQ is weird...I don't know if I could dispute the EQ one since its last status WAS 120 days late, but definitely Transunion....How though? Send letters to Capital one or the CRAs/Transunion? And what kind? I keep reading how evil Crap1 is and how much they screw people, so I'm scared. This is the only problem on my reports besides multiple spellings of my name. My score is still pretty good, but this is killing me and I'd like to apply for an auto loan asap..so I don't want my score going lower because of a "dispute" either. As I've read has happened to some people.. If there really is a good chance of my score dropping because of a dispute then I think I'll just apply for the auto loan first.Any tips on where to start? miracle
You could contact the OC although I hear Crap1 isn't all that happy to help people out. I would personally dispute it with the CRA, but you do run the risk of having the whole thing deleted. If it was a settled account, that may not be a bad thing at all. Good Luck! -Jenn
divemedic
I would dispute as inaccurate. How can an account with a $0 balance be late? Also, it can't be accurate as they don't even agree with each other. What you do is send a letter to Cap1 one, informing them the account is not correctly reported. Then dispute with the CRA's. If it isn't fixed, repeat the process. Then you will have the evidence to sue for willful noncompliance with the FCRA, under s2b.
breathing_easier
LikeItOrNot: I have a negative OC TL on TU that is almost identical to yours. Settled in December 2002 before finding these boards and while the "Condition" section reads that the account was "Closed (Paid)" reads "Late 120 Days." My disputes with TU always come back verified. After failing with TU to have this account deleted entirely or updated correctly, I sent letters to the OC and then called them explaining why this TL was incorrect and that it needed to be updated if they wouldn't agree to delete (as requested in my initial goodwill letter to them). Their response to me was that since the account had been 120 Days late at the time of chargeoff, then it was correct reporting, even though the account was subsequently settled. I say that once the account was settled (and I subsequently paid income tax via a 1099-C on the forgiven portion), that negates them being able to ever again call it 120 Days Past Due. If they say it is 120 Days Past Due, in my opinion that means that the account is currently past due. In fact, even though all of my collection accounts were paid in full or settled in 2002, and I have had no negative credit activity since that time, my "Summary Information" on TU lists one "current delinquency" due to the way this TL is reporting. This has been going on for more than a year and so far, even though I know I'm right and that the OC's stance is rubbish, I haven't been able to get them to budge. Therefore, even though I hate the hassle of it, my only recourse now is to send the OC an ITS letter and, if no relief there, than to actually file suit for FCRA violations. You may end up having to do the same with Cap1.
LikeItOrNot
Thanks all.Breathing_Easier,Did your FICO scores go down at all from trying to dispute it? And does your 2yr payment history looke exactly like that though? To me, that says the account was still open in 2003-2004. If the last "Current Status" was 120 days past due, then how can they say that my account was "OK" Feb-May.. I called Capital One and they even confirmed that it was closed in July of 2001. If they could tell that by looking my name up in the computer... How could they verifiy TU's info is correct.. Should I ask the general customer service reps at Cap1 to send me proof that the account was closed. Would that help me?Guess I got some letters to write. I'm suing if I have to.
