Carlos
Which type of Agreement does a utility company phone bill or cell phone bill represent? 1) Oral Agreement 2) Written contract? 3) Promissary Note (auto loan, mortgage loan)4) Open Ended Account ? (credit card)I would think that it is obviously not an oral agreement or a promissary note. However I am not sure whether it would be a Written contract or Open Ended account. Since the long distance portion of your phone bill lets you "charge away" in a similar manner to a credit card I would lean toward the phone bill being an Open Ended Account. Can someone please help me out here? Is there any reference regarding this subject anywhere? I have already reaad the small paragraphs under the Consumer Info::SOL section, but I still need further clarification.
aints68
I was asking this same question a few months ago, as I was also having a hard time finding an answer to this. A few very knowledgable people helped me out. The answer from both of them was that a cell phone bill would be an open contract, same as a credit card. Hope this helps you out. Carlos
Good, So then I would assume that a plain ol' telephone service (POTS) line would fall under the same category. If this is true then the CS is at least 3 years overdue and its time to sue.
