blackgossamer Posted April 28, 2005 Report Posted April 28, 2005 I received a letter today from ASG (Accoutn Solutions Group) for an account from Capital One. I settled this account this month. After asking several times of a settlement I finally got it accepted on 4/10. Cap1 said they need my payment by 4/15/05. I immediatley sent the check out with a copy of the settlement acceptance from Cap1. It cleared my bank on 4/18/05 and it is stamped 4/14/05. So I know that they recived the check by the date and it was not returned. They said they will monitor my account for 21 days after(May 6) to verify it does not bounce and then it will be "settled". So now I apprantly have the remaining balance with ASG. I was going to send them a DV stating that the account was settled and I do not owe and include the settlement letter and copy of my cleared check. I wanted to see what you guys thought. Should I also send something to Capital One for selling the remainer even though I held up my end of the deal? Thanks, mimi
Recovering Attorney Posted April 28, 2005 Report Posted April 28, 2005 SOunds like cap One didn't informt eh CA. I'd write a letter addressed to both of them with the documentation stating that since Cap One took your deal, the matter is concluded and you owe nothing more. Advise them that if they do anything regarding the alleged balance, such as report it to a CRA, you will consider that a violation of the law. ay that the letter invokes your rights under the federal and state FDCPA and FCRA. cc: the FTC and OCC
blackgossamer Posted April 28, 2005 Author Report Posted April 28, 2005 well as far as I know it wasn't in collections when I made the settlement. It was $545.40 I settled at $200 and these guys just sent me the letter and it says balance $345.40 as of 4/25/05 so it was obviously done after the fact. So I thought it looked they sold it even though we had an agreement. I thought that was illegal.I will write the letter though. Should I not include a DV with the copy to the CA?Thanks your help!
Recovering Attorney Posted April 28, 2005 Report Posted April 28, 2005 Yes. I would DV the CA. And send the strong letter to the two of them under seperate cover. Better, address the Cap One part to : Richard Fairbanks CEO, Capital One Financial Services, 1680 Capital One Drive, McLean VA 22102. You'll get a response from the executive office.
Guest Posted April 28, 2005 Report Posted April 28, 2005 ASG is one of Cap Ones favorite collection agencies so yeah apparently Cap One forwarded it after settlement. Please check your settlement letter and make sure that you in fact settled in full
blackgossamer Posted April 28, 2005 Author Report Posted April 28, 2005 It says, after an apology for not helping me previously, "I am pleased, however, to accept your settlement offer of $200.00. If we receive a total payment of $200.00 by April 15, 2005, we will consider your account settled and stop collection efforts." It also says later they will monitor the account for 21 days to verify that the payment is not returned but after that if it is not then they will send me a separate notice "confirming that the settlement is complete and the credit bureau agencies have been notified." It's from Rebecca Davis, Executive Offices, Capital One Services. I have her number too. I'll send out the letters tomorrow and see what happens. I guess if I don't get my notice by mid May I should worry.
