lumburg
Hello all, and thanks in advance for all the help!I have a couple of questions around the DV process as I am about to enter into it. First, if you have paid the CA already, can you you still DV and are they required to respond in the same manner if you did not pay? Aslo, if I did pay and they do not validate, can I recoupe the money I paid them in court? Finally, in most peoples expierence, do the CAs tend to respond to DV letters or do they largely blow them off? I am dealing with Jefferson Capitol and IC Systems if anyone has ever dealt with them. Thanks again!
GreatGadsby
Aslo, if I did pay and they do not validate, can I recoupe the money I paid them in court?if you didn't pay them, the what did you pay them in court? have they sued you? if you're referring to court costs (filing fees, etc...) yes they can be recovered IF you win, you just have them included in your original request for all the money you're seeking. statutory damages, actual damages, punitive damages as deemed appropriate by the court, court costs.......... and so on
lumburg
I paid to CAs like an idiot before I found this board. I am going to DV those 2 tomorrow and am looking to see what is the likelyhood that they respond, and if they don't respond through the entire DV process as desribed by this site, can I collect the money that I already paid them? Thanks
GreatGadsby
not really... if you can succesfully sue them for violations of various laws, then you can consider the amount of money you win as repayment of what you paid them, but i don't think you can sue them for the money you paid them. I only say this b/c the suits under FCRA and FDCPA are not about the underlying debt, they are about the CA's behavior while attempting to collect.
