OK SOL confusion

Hey there:

I'm a little confused. . Asset Acceptance is attempting to collect on a debt they claim is mine from 1993 (I know . . . it's 12 years old!!!). First of all, I have NO memory of this debt and it's for a Lane Bryant account that I really can't imagine I would ever have had (Lane Bryant is a store for bigger women and I'm 5' 2" tall and have never weighed more than 125 pounds, but I digress . . . ) so I sent them a DV letter, to which they replied w/ one of their bullsh*t printouts.

In addtion, due to the age of the debt, I have been planning on sending them a SOL letter. However, today, I came across a thread that implied that, in OK, there is a real question as to whether it's wise to try to invoke the SOL. As best I can tell, the problem seems to be in the way OK defines credit cards as either "open accounts" or "written contracts." So, this made me a little leery of sending the SOL letter since a couple of people seemed to believe that sending it would put me on a "fast-track" for a lawsuit . . . that I could lose.

However, in looking at the SOLs I see that, regardless of how it's defined, the debt being 12 years old makes it out of SOL in OK (I've never lived anywhere else) regardless of how it's defined. Is this right?

The TOTAL amount they say I owe them is $269.01, so I can't imagine it would be in their financial best interests to pursue this but still . . .

Thanks in advance,

Didi

The SOL has far been gone for this, the SOL gives you an affirmative defence in case they do file a lawsuit, which I seriously doubt for the amount you put down. check out the "dispute/past SOL"letters in the links above, they are out of luck and they know it, they probably paid a few cents fopr the account and are hoping you don't know your rights, don't talk to them on the phone, dont give them any bank info at all....don't even acknowledge the debt is yours, it also shouldnt be on your credit reports.......the folks here will do their best to help ya......no worries :D

Thanks for the quick reply, rommel. I really appreciate it.

I don't have much experience w/ this (only one run in regarding an old bursar's bill from college that was settled relatively painlessly) and am easily confused by all of it. :p
