Need help with 2nd DV letter

Recommended Posts

AFNI --

they received my CMRR

still continued to attempt to contact by phone

validatd with CRA

and "attempted" to validated with me.

In my package was --

their license/permit #'s for NC, NY and MN. I'm in MI and while I do understand they're licensed here til end of June funny it wasn't included.

The paperwork info they sent me shows

Cingular Wireless &

Ameritech Cellular Service (are these the same co??)

Now I realize that this wasn't all that I had requested from them. Now I cite the violations of still attempting to collect on the debt even though I DV'd them?

Not marking my account IN DISPUTE with the CRA?

I'm still waiting on hearing back from the CRA as I contacted them and disputed as NOT MINE once I got my greens back in the mail.

you've already got them on numerous violations. Go ahead and sue them and get some $$$ for ya!

I sued Attention LLC for -one- violation of verifying with the CRA's after I sent DV. And I got 3k out of it. (still waiting on the check) But under Texas law, you can get more than the 1k under Federal.

Go ahead and sue!

RE: 2nd DV request on account 0000000

To Whom:

On xx/xx/xx, I received your response to my DV request dated xx/xx/xx. Your response failed to provide me with all the information I requested. Please provide the following:

* Item 1

* Item 2

* Item 3

* Item 4

Your prompt response is appreciated.

Just keep a list of violations for now and the date they occurred. After they respond to 2nd DV, list the violations on your ITS letter.

With the 2nd DV letter, would you add that they have 15 days to get fully validated? And would you also let them know that if they can't provide the information that you are taking them to court? Sorry for my nooby-ness.

keep in mind though that the CA is not required to send you everything you might be asking for. they are only required to provide competent evidence that the debt does belong to you and how they arrived at the balance owed. the stuff in the letter about requesting licenses and signed documents is great, but they don't necessarily have to send you everything in the letter.

just a thought.

So in fact they are not required to provide me with the complete documentation in the DV letter?? So as far as qualifying as proper validation its just a matter of my opinion VS theirs?? Thats a bit unsettling.

I in fact got a hand written bill with the date of 2/2000. Debating on just laying low with them for the next 9 months til SOL falls off. IF thats even possible......

I needed a sample 2nd DV letter, also. But what about also mentioning they are in violation of the FDCPA Section 809(B) and the fee for violating it is $1,000? Would that most likely cause them to sue you? Also where is the FTC opinion letter and should we quote a legal case? Or do they just laugh because they know we aren't attorneys?

How do you get more than $1,000 in federal court? Ask for damages of some sort?
