chincheck
Most likely you'll have to file in federal district court, but some states will allow you to file in state court on this one.Yes, you do have a violation. Before you run to court, send them another DV letter. Then, dispute the entries with the CRA's. If they violate again, then send an ITS letter stating what laws they broke and on what dates.Going this route will establish a pattern of willful noncompliance. If you're allowed to file in a state court, you also may be able to tack on punitive damages.
