I disputed online with TU on March, 2nd 2005, and have not heard anything from them. On 04/13/2005 I sent them the first letter and recieved a letter stating the length of time that everything stays on the credit report. Today I sent them a second letter stating that I intended to take legal action against them.

First letter;

RE: Online Dispute

Dear Credit Bureau,

This letter is formal notice that you have failed to respond to my dispute filed online. I filed this online dispute with you on March 2,2005 and have enclosed a copy of the return e-mail that your company sent me on March,2 2005

As you are well aware, federal law requires you to respond within 30 days. It has now been over that period since your receipt of my online dispute. As you are no doubt aware, failure to comply with federal regulations by credit reporting agencies are in serious violation of the Fair Credit Reporting Act and may be investigated by the FTC. Obviously, I am maintaining detailed records of all my correspondence with you.

Since your company has failed to respond to my online dispute,I am requesting that said information be removed. I'm sure you'll want to handle this matter as soon as possible. For this purpose, I have included a copy of the dated e-mail of your reception of the original online dispute.

The following information therefore needs to be deleted from the report as soon as possible:

Since your company has failed to respond to my online dispute and the letter sent to you on April 14th 2005,I have no recourse but to start legal action against your company under the FCRA and I am sending a copy of this letter and all correspondence with you to the Federal Trade Commission so that they may start an investigation.

I also sent with this letter copies of the CMRRR,a copy of the e-mail that I recieved from them ,a copy of the 1st letter, and a copy of the track & confirm from the USPS website.

A couple of questions? How long do I give them to respond, and did I shoot myself in the foot by doing this, and can anyone give me an idea where I can find any state laws that they may have broken in South Carolina

Thank for the help....

Frank

Im confussed , unless im just missing something ?

You diputed by letter to the CRA's the first time on 4/13/05 , correct ? They have 30 days plus allow 5 days mail time to respond to your dispute. So if you disputed on 4/13 they have till about 5/18 ( including mail time ) to respond. So their time to repond isnt up yet.

Then you disputed ( was it the same accounts ? ) on 5/2/05 ? and sent a letter to them 3 days later because they did not respond ?

Is that right are are the dates mixed up ?

I paid for a CR from TU on 3/2/2005 and disputed 16 items on the same day online and waited until 4/13/05 to send them a letter telling them that the 30 + 5 days were up and that I want the items deleted then today I sent them the 2nd letter.

Here is the e-mail that was sent to me on 3/2/05.

Thank you for visiting TransUnion.com. We have received your dispute request and have started our investigation. We understand the importance of this information and will work quickly to resolve your dispute and update your file accordingly. To do this, we are taking the following steps:

1. TransUnion will contact the party that provided the information and request it to verify the accuracy of the information.

2. The party will then inform TransUnion of any changes that should be made to the information.

3. TransUnion will mail you an updated copy of your credit report, reflecting the results of the investigation. We will send this to you via U.S. mail usually within 30 days of receiving your initial request. Mail delivery typically takes 3-5 business days.

If you are not satisfied with the resolution of the investigation, you may add a consumer statement to your TransUnion credit report. This is a section of your file where you can provide additional explanation. If you would like, we can even help you write this statement.

When you have a dispute pending, we recommend that you not apply for credit, as the results of the investigation may affect a new credit decision.

Again, thank you for visiting TransUnion.com. We hope we have been of help and we look forward to serving you in the future.
