My problem is I have a car loan that I seem to get a few days behind on each month. The creditor calls me daily when I am over 10 days late. I have requested several times to be removed from teh auto-dialer, to no avail. 1. Is this legal?2. Your other choice is to change your phone number and don't give it out.I have in the past called a creditor, and when they verify information, given them fake info. 9 out of 10 just update a computer database and don't keep the previous info, so you might try that too. That's the same thing my bf does. his payment is due on one date, but since it's not considered late until 10 days later, he just pays it then. Revco Posted May 7, 2005 Report Share Posted May 7, 2005 If you're having trouble making the payments on time, you might try to work with them to change your billing cycle to be more conveinient for when you can pay them. That way, you make the payment when you can and you don't get the phone calls.Technically, even one day lates can be reported as 30 day lates on your CR. Guest Posted May 7, 2005 Report Share Posted May 7, 2005 Technically.. if you have proof that a payment was made on a date other than 30 days late then you technically have them on a violation of the FCRAIt states that only 100% accurate information can be reported...Is reporting a payment that was due on Jan 1.. paid jan 11..and not 30 days late til Jan 31 accurate?!?!?!?No its not and by law is a violation.Its all rather simple..the law is the law...
