jq26
I have a CA account that was paid directly to the OC in full prior to discharge. But the CA is reporting incorrectly as Included in bankruptcy/Charge-Off as of 6/04. The issue being contested with them is whether or not the account should have been recalled or remain and marked as IIB- but either way CLOSED for 11 months now. After four letters to CEO and one letter back, they basically told me to f off. I sent an Intent to Sue letter yesterday morning to the CEOs home and certified to the collection agency. Sure enough, they did a hard inquiry on my experian report yesterday afternoon. Knocked my score down a few points of course. But the bigger issue is the fact that they seem to have access to all of my info at will. Did they have a permissable purpose to do a hard inquiry???? Revco
No, I don't think they have permissable purpose to pull your CR due to the fact that it's considered a closed account and you didn't sign a waiver. As far as what I would do, if you have proof of payment to the OC and a copy of the final bill...I would take the fight to the CRA. Send them a copy of both and request removal.I didn't see that you did a DV with the CA...you will definately want to do that to see what they're reporting. Also...an ITS means you INTEND to sue and should definately follow through. Otherwise, they have you on harassment.
jq26
thanks for the reply. I DV'ed the colection agency three times and disputed twice with each CRA (three times with TransUnion). The collection agency verified a total of 7 times and then finally sent me a letter telling me "because I keep persisiting, they'll refresh my memory that I had an auto loan". That's it. No account numbers, nothing. And it was from the president of the collection agency. So I responded the next day and told him this was unacceptable and I want proof because the account should not be on my reports. Heard nothing for 35 days, then just sent them an ITS. Let me add they never marked the account as "in dispute" either, then they yanked my credit (hard pull?!) on Friday afternoon with no permissable purpose 14 months after the CA account should have either been closed or been recalled. Am I missing something here? I have no problems taking them to district court, but I need to know I have a solid case before I do so. EVERY piece of correspondence was certified so I should have sufficient proof. I am doing my best to keep a level head but their last little trick of pulling my credit w/out permission has got me ticked off. I am not certain what typical industry practice would be for a late car payment that was sent to a CA and then the customer just makes a double payment directly to the creditor the next month and gets the account current. Is the CA account just marked closed on my CR, or should the account be recalled completely and disappear? Does anyone know the answer to this?
