creditrookie
I received a letter from a CA 2 weeks ago trying to collect a debt of $775.00. I DV'd them using the letter on this sight as a guide and they received my letter CMRRR 4 days later. 5 days after that they sent me a letter stating they were requesting documents from their client. The next day they tried calling me. I want to send this letter but dont know if it is applicable. To whom it may concern:This letter is in response to youir attempt to collect the above refernced debt. Be advised this is not a refusal to pay, but an attempt to make sure you are following the law.FDCPA Section 809 (Enclosed you will find a copy of the letter dated ________ requesting your company validate the debt you are attempting to collect pusuant to the above referenced title and section. Also enclosed, please find a copy of the receipt from the USPS website and the receipt signed by an employee of your firm confirming your receipt of this letter on ________.You are in violation of the FDCPA. I received your letter dated _____, signed by whatshername, stating you were requesting the proper documents from your client. All communication should have stopped at that point until proper validation was forwarded to me, yet you were still attempting to contact me by telephone. The most recent attempt logged on my caller ID was _____ at _____am.You may also be in vialoation of 805 ©At the bottom of my letter requestin validation it clearly states that you cease and desist with any attempts to contact me by telephone and all communication should be by USPS. "If such notice from the consumer is made by mail, notification shall be complete upon receipt"Again please see notated abovereferencing my call id.So you are aware, no continued collection activity may take place until validation is made and an opinion letter posted by the FTC on its website, states that calling, writing, reporting to the credit bureaus or selling a debt may be considered continued collection activity. You are already in violation and though I perfer not to litigate, I will use my rights as a consumer to make sure you obey the law. I look forward to an uneventful resolution to t his matter.Sincerely,MEEnclosuresWill this work and does it sound ok.
Revco
I like it. I found a few spelling errors...you'll want to fix those. The following statement seems a bit redundant of the previous paragraph. You might try to consolidate/shorten them."So you are aware, no continued collection activity may take place until validation is made and an opinion letter posted by the FTC on its website, states that calling, writing, reporting to the credit bureaus or selling a debt may be considered continued collection activity. "Other than that...I think they need to be aware you're watching them like hawks.Good luck!
